Services Description

HeySamir provides UI/UX design, web design consulting, digital product strategy, interface design, and related creative services. All deliverables, timelines, and project scopes will be defined in separate project agreements or proposals. These general Terms govern the use of our website and informational content.

• Custom UI/UX design for websites and mobile applications
• Design consultation and user research
• Prototyping and interactive wireframes
• Design asset delivery in standard formats (Figma, Adobe XD, Sketch, etc.)
• Optional post-launch support and maintenance (subject to separate agreement)

Intellectual Property Rights

All content, branding, design assets, graphics, code snippets, and original works provided by HeySamir remain the intellectual property of HeySamir unless otherwise transferred via a paid project agreement. Upon full payment for a specific design project, the final design files and ownership rights defined in the proposal are transferred to the client. However, HeySamir retains the right to showcase the work in portfolios and case studies.

• Unauthorized reproduction or redistribution of our website content is prohibited
• Client logos and materials submitted remain client property
• Any third-party fonts, icons, or assets used are subject to their respective licenses
• You may not copy, reverse-engineer, or exploit our proprietary design processes

User Obligations & Acceptable Use

When using the HeySamir website or communicating with us, you agree to provide accurate information and refrain from any unlawful or harmful activities.

• Do not attempt to hack, disrupt, or damage our website or servers
• Do not upload malicious code, viruses, or content that violates any law
• Respect confidentiality of any project discussions and non-disclosure agreements
• Provide clear feedback and necessary assets in a timely manner for project success

Payments, Fees & Refunds

Pricing for design services is outlined in project quotes or proposals. A deposit or upfront payment may be required before starting any work. All fees are in Indian Rupees (INR) or as agreed in writing. HeySamir does not offer refunds for completed design work, but we are committed to client satisfaction and revisions as per project scope. For website maintenance or subscription services, refunds are governed by the specific terms in that agreement.

Limitations of Liability

To the maximum extent permitted by law, HeySamir shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use our services or website. This includes loss of profits, data, business interruption, or any other intangible losses, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from these Terms shall not exceed the amount paid by you to HeySamir in the past six months.

• We do not warrant that the website will be error-free or uninterrupted
• Design deliverables are provided “as is” after final approval
• Third-party tools integrations are subject to their own liability terms

Termination & Suspension

HeySamir reserves the right to terminate or suspend access to our website or services immediately, without prior notice, for conduct that violates these Terms or is harmful to other users or the agency. Upon termination, your right to use the website ceases immediately. Any outstanding payment obligations survive termination.

Governing Law & Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising from these terms or your use of the website shall be subject to the exclusive jurisdiction of the courts located in Nagpur, Maharashtra, India.
